Most people are under the impression that the only way they can actually be charged with DUI—Driving Under the Influence—is to actually be driving. You may be surprised to find that is not actually the case. As it turns out, it must only be shown that you were in control of the vehicle—that is, you could have driven if you had chosen to do so—and that you were over the legal limit, and you will be facing a charge of Physical Control.
